OFFICIAL RULES
NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. BY PARTICIPATING IN THIS GIVEAWAY, PARTICIPANT AGREES TO BE BOUND BY THESE OFFICIAL RULES, WHICH SHALL BE FINAL IN ALL RESPECTS.
1. PROMOTION PERIOD: The Princeton Review 2017 Back to a School SWAG Giveaway (“Giveaway”) starts at 12:01 a.m. Eastern Time (“ET”) on August 14, 2017 and ends at 11:59 p.m. ET on October 13, 2017 (the “Promotion Period”).
2. ELIGIBILITY: The Giveaway is open to legal residents of the fifty (50) states of United States, the District of Columbia, Puerto Rico and Canada (excluding Quebec) who are 18 years of age and older as of the date of entry (“Entrant”). Employees, officers and directors and their immediate families (spouses, parents, siblings and children and those living in the same households whether or not related) of the Sponsor, its affiliates, subsidiaries, consultants, contractors, legal, advertising, public relations, promotional and marketing agencies are not eligible to participate. This Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram.com (“Instagram”) and/or Twitter, Inc. (“Twitter”). By entering this Giveaway, Entrant agrees to a complete release of Instagram and Twitter from any or all liability in connection with this Giveaway. Void where prohibited by law. All federal, state, provincial and local laws and regulations apply.
3. HOW TO ENTER: Follow The Princeton Review @theprincetonreview on Instagram or on Twitter @ThePrincetonRev. During the Promotion Period, visit one of The Princeton Review’s many events near you and take a selfie with one of The Princeton Review’s emoji props available. Choose the emoji prop that best represents how you are feeling about returning to school. Post the selfie on Instagram or Twitter with hashtag #BacktoSchool17 and tag us. Posting of a picture that follows the Photo Guidelines constitutes one (1) entry per social media. At most two (2) entries [one (1) through Twitter and one (1) through Instagram] per individual is permitted. Each Entrant consents to be contacted by Sponsor via direct message on the social media the Entrant used to enter Giveaway. The Entrant’s Photo must comply with the all guidelines contained in Photo Guidelines below. All entries become the property of Sponsor and will not be acknowledged or returned. All eligible entries must be received by 11:59 p.m. ET on October 13, 2017 to be eligible for the random drawing on or about October 18, 2017. Multiple entries from any person will result in all of the person’s entries being voided. Anyone found to use multiple accounts to enter will be ineligible.
Alternate method: If Entrant does not wish to enter Giveaway using any social media, or does not have internet access, then entrant may enter the Giveaway in writing by handwriting his or her name, complete address and phone number on a postcard and mail to: The Princeton Review, c/o Back to School SWAG Giveaway, 110 East 42nd St., Suite 700, New York, NY 10017. Mail-in entries must be postmarked no later than October 13, 2017. Limit one (1) entry per person. Sponsor is not responsible for lost, late, misdirected, illegible and/or incomplete entries due to mail delivery service, computer or electronic malfunction or other error. Any entry that is submitted with the use of an automated device will be void. All entries become the property of the co-sponsors and will not be acknowledged or returned. Unreadable, inaccurate, unintelligible, or Entries which otherwise do not comply with these Official Rules will be disqualified.
4. PHOTO GUIDELINES: Photos must be original and have been created solely by the Entrant. To be eligible for the Giveaway photos must comply with the following: (1) the Photo must not exhibit the Entrant engaging in or otherwise promoting any illegal, violent, dangerous or discriminatory behavior or contain any material that is threatening, indecent, violent, obscene or offensive, or that promotes a political agenda; (2) the Photo must not include any brand name, trademark or logo of any entity (other than brand names, trademarks or logos associated with The Princeton Review); (3) the entrant must own the copyright in the Photo; (4) the Photo must not previously have been previously published or won any award; (5) the Photo must not contain any material that violates or infringes upon the rights of any third party, including without limitation any copyright, trademark or right of privacy or publicity, or that defames any person, or that is unlawful, in violation of or contrary to any applicable law or regulation; (6) if the Photo identifies, depicts or contains any person other than the Entrant, the Entrant must have prior to submission obtained written consent from such person (or his or her parent or legal guardian, if the person identified or depicted is included is a minor) to the use by the Entrant of the Photo including such person’s name, image, and/or other identifying information, as applicable; AND (7) the Photo must not contain any material that Sponsor, in its sole discretion, deems inappropriate for public viewing and/or display. Sponsor reserves the right in its sole discretion to disqualify any Photo that Sponsor determines does not comply with these guidelines.
5. WINNER SELECTION AND NOTIFICATION: On or about October 18, 2017, the Sponsor will select three (2) first prize winners and thirty-five (35) second prize winners at random from among all eligible entries received during the Promotion Period. Sponsor will contact the winners through direct message via the social media account used to enter the Giveaway. After notification, Sponsor will post the name of the winner on Sponsors Instagram and Twitter account. Residents of Canada will be required to enter a skill-testing question to claim their prize. Odds of winning depend on the number of eligible entries received during the Promotion Period.
6. PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”): First Prize: Three (3) winners will receive their choice of a GRE, GMAT, LSAT or MCAT LiveOnline Ultimate course (each course valued up to $2,799.00). Second Prize: thirty-five (35) winners will receive their choice of a one (1) title of a retail The Princeton Review book currently published by Random House (valued up to $29.99). The total ARV 3,848.65. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. No cash substitution, assignment, or transfer of any prize permitted. In the event a prize is unavailable, Sponsor reserves the right to substitute a prize of equal or greater value. Winners are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion.
7. INTERNET: If for any reason this Giveaway is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Giveaway, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer relating to or resulting from participating in this Giveaway or downloading any materials in this Giveaway. SPONSOR IS NOT RESPONSIBLE FOR INCOMPATIBILITY OF ENTRANT'S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY WITH SPONSOR'S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHERREMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity or eligibility of a winner based on a Twitter or Instagram account, the winning entry will be declared made by the "Authorized Account Holder" of such account at time of entry. "Authorized Account Holder" is defined as the natural person 18 years of age or older who is assigned to an account by the company or organization (e.g., Twitter or Instagram) that is responsible for assigning the account. Sponsor may ask any Entrant or potential winner to provide Sponsor with proof that such party is the authorized account holder of the account associated with the entry
8. GRANT OF RIGHTS: By entering the Giveaway, each entrant irrevocably grants Sponsor and its affiliates, (collectively, the “Released Entities”) the right to use the entrant’s name, likeness, biographical information, in perpetuity, throughout the universe, in all media and formats, whether now known or later developed, for commercial purposes and any other purposes (including, without limitation, advertising and promotion, without further compensation unless prohibited by law. Further Entrant irrevocably grants the Sponsor and its affiliates a non-exclusive license to publish, display, reproduce, modify, edit, create derivative works bases on or otherwise use the entrants Photo in whole or in part, in perpetuity, throughout the universe, in all media and formats, whether now or later known or developed (including without limitation on Sponsor’s websites and social media channels), for commercial purposes and any other purposes (including, without limitation, advertising and promotion), without further compensation, unless prohibited by law.
9. USE OF INFORMATION: The information that you provide in connection with the Giveaway may be used for Sponsor's internal purposes and to send you information about Sponsor's products and special promotions and may be shared with Sponsor’ affiliates or third parties. 10. RELEASE: Winner will be notified by direct message to the account used to enter within one (1) business day after prize winner is determined. The Winner will be required to execute and return a Prize Verification Form and Publicity Release (unless prohibited by Law) to the Sponsor within three (3) days of notification. If the selected Winner is not an eligible entry, fails to comply with the Official Rules and/or to submit any required documentation within the designated period, or declines the Prize for any reason, that Winner will be disqualified and the Prize will be awarded to an alternate winner in a random drawing from among all remaining eligible entries. Sponsor is not responsible for any change to your email, mailing address and/or telephone number.
11. GENERAL: By entering Giveaway, entrant accepts and agrees to these Official Rules and the decisions of Sponsor, which shall be final in all matters. By accepting prize, winner agrees to hold TPR Education, LLC, their affiliates, directors, officers, employees and assigns harmless against any and all claims and liability arising out of use of prize. Acceptance also constitutes permission for the Sponsor to use winner’s name and likeness for marketing purposes without further compensation or right of approval, unless prohibited by law. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook or Instagram. Entrant is providing his or her information to the Sponsor and not Instagram or Twitter. All federal and state laws apply. In the event the Sponsor is prevented from continuing with this Giveaway, or the integrity and/or feasibility of the Giveaway is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute, or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, provincial or local government law, order of regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor's control (each a "Force Majeure" event) the Sponsor shall have the right, in their sole discretion, to abbreviate, modify, suspend, cancel or terminate the Giveaway without notice or further obligation. If the Sponsor, in their discretion, elect to abbreviate, cancel or terminate the Giveaway as a result of a Force Majeure event, the Sponsor reserve the right, but shall have no obligation, to award the prizes from among all valid and eligible entries received up to the time of such Force Majeure event.

13. DISPUTES: Except where prohibited, Entrant agrees that any and all disputes, claims and causes of action arising out of the Giveaway shall be resolved individually, and exclusively by the appropriate court located in the State of New York, and the law of Texas shall govern such disputes.
